Economic Crimes Defense in Moscow: Business Owners, Directors and Chief Accountants
An economic criminal case almost always grows out of a civil or tax dispute: a field tax audit report, a bankruptcy, a conflict with a partner, an unperformed contract. The earlier the defense starts, the more decisions remain yours, from calculating the amount of damage to compensating it, which for many offences releases a first-time offender from criminal liability.

Business fraud: three thresholds
Parts 5–7 of Article 159 apply when the parties to the contract are entrepreneurs or commercial organizations. The thresholds are set by Note 1 to the article as amended by Law No. 79-FZ of 06.04.2024.

Bar heights are on a logarithmic scale starting from RUB 100,000 at the base.
Three Principles
The civil and tax basis comes first
The amount of damage or tax arrears in a criminal case is taken from the tax audit report, the inspectorate's decision or the arbitrazh court's judgment. A dispute over the amount in the arbitrazh court can change the classification of the offence or remove its elements. The defense therefore starts with the documents of the dispute, not with the interrogation.
Compensation is a calculated decision
Article 76.1 of the Criminal Code releases a first-time offender from liability once the damage is compensated: for Arts. 198–199.1 — in full; for Art. 159(5)–(7), Art. 160(1), Arts. 195–197, Art. 199.2 and several others — together with a payment to the federal budget, as a rule twice the amount of the damage. The decision to compensate is made after a calculation, not under pressure from an investigator.
Liability follows the facts
Liability lies with whoever actually made the decisions. The nominal director, the chief accountant and the owner may end up in one case with different roles, so each person's position is built separately and checked against the documents.
An economic case starts long before it is opened: with a tax audit report, a claim letter or a bankruptcy petition. That is where defense costs least.

Typical Situations
This is how such questions usually sound. Names and case details are not disclosed.
- The tax office has passed the audit materials to the Investigative Committee. What happens next, and can the case be stopped?
- A partner has filed a fraud complaint over an unperformed contract. Is this a civil dispute or a criminal case?
- The bankruptcy trustee alleges deliberate bankruptcy. Does this threaten the former director?
- The police invite us to an informal interview. Should we go, and with whom?
- The company is ready to compensate the damage. Will this release us from liability, and how much will it cost?
- One person was registered as director while another made the decisions. Who will be held liable?
Specific Actions
- Defense during the pre-investigation check: explanations, documents, motions, complaints about delays.
- Accompanying interviews and interrogations at the Investigative Committee, the Interior Ministry and the Tax Service — see interrogation defense.
- Calculating the damage and tax arrears: what counts toward the criminal amount and where the article's threshold lies.
- A compensation strategy under Art. 76.1 of the Criminal Code and termination of prosecution (Art. 28.1 of the Criminal Procedure Code).
- Preventive measures: objections to custody under Art. 108(1.1) of the Criminal Procedure Code; house arrest or a ban on certain actions instead of custody.
- Defense in tax (Arts. 198–199.2) and bankruptcy (Arts. 195–197) cases and under Art. 159(5)–(7), Arts. 160 and 201 — see also tax audit defense.
- Linking with the arbitrazh court: a dispute over the tax assessment or the debt on which the amount of damage in the criminal case depends.
Working Procedure
- On the day you call — summons, order, tax audit report or a counterparty's complaint — the attorney determines the stage of the case
- Calculation — amount of damage, the article's threshold, limitation periods (Art. 78 of the Criminal Code), the possibility of release under Art. 76.1
- Position — separately for each participant: owner, director, accountant
- Stage — pre-investigation check, investigation or trial — motions, complaints, participation in investigative actions
- Outcome — refusal to open a case, termination of the case or defense at trial

Most Common Questions
?Which crimes count as economic?
In the Russian Criminal Code these are first of all the offences of Chapter 22, «Crimes in the Sphere of Economic Activity»: tax offences (Arts. 198–199.4), bankruptcy offences (Arts. 195–197), illegal business and banking, money laundering, currency offences (Arts. 193, 193.1). Business cases also include fraud (Art. 159, including parts 5–7 on non-performance of contracts between entrepreneurs), misappropriation and embezzlement (Art. 160) and abuse of authority (Art. 201).
?How does business fraud differ from ordinary fraud?
Parts 5–7 of Article 159 apply when the parties to the contract are entrepreneurs or commercial organizations and the obligation was deliberately not performed. The thresholds are higher than for ordinary fraud: significant damage starts at RUB 250,000, large is over RUB 4.5 million, especially large over RUB 18 million. As a rule, the case is opened only on the victim's complaint (Art. 20(3) of the Criminal Procedure Code).
?Can a person be taken into custody in an economic case?
For the business-related offences listed in Art. 108(1.1) of the Criminal Procedure Code, custody is allowed in only three situations: the person has no place of residence or stay in Russia, has breached an earlier preventive measure, or has absconded. Otherwise, house arrest, bail or a ban on certain actions are considered.
?Does compensation release from criminal liability?
Yes, if the offence was committed for the first time and the article is listed in Art. 76.1 of the Criminal Code. For Arts. 198–199.1, 199.3 and 199.4, full compensation of the damage to the budget — arrears, penalties and fines — is enough. For Art. 159(5)–(7), Art. 160(1), Arts. 195–197, Art. 199.2 and several others, a payment to the federal budget is also required, as a rule twice the amount of the damage. The case is then terminated under Art. 28.1 of the Criminal Procedure Code.
?Should I attend an informal police interview?
What you say at an interview stays in the materials of the check and is later read together with the case. During the check of a crime report everyone has the right to an advocate and the right not to testify against themselves (Art. 144(1.1) of the Criminal Procedure Code), so it is better to attend with an attorney and after reviewing the documents.
?What is the limitation period?
It depends on the category: two years for minor offences, six for offences of medium gravity, ten for grave and fifteen for especially grave offences (Art. 78 of the Criminal Code). For example, Art. 199(1) is a minor offence with a two-year limitation period.
?How much does an economic crimes lawyer cost?
A consultation is RUB 5,000 for 30 minutes by voice or RUB 15,000 for an hour by video with a written summary. Accompanying an interview or interrogation starts at RUB 50,000; defense starts at RUB 200,000 per stage: pre-investigation check, investigation, trial. The law does not allow success fees in criminal cases.
